A record of site condition (RSC) is a document that summarizes the environmental condition of a property and is filed in a public registry.  It is determined by a “qualified person” after conducting a Phase I, Phase II (if necessary) and sampling, and, in the case of a site cleanup, to substantiate that certain standards are met for soil, sediment and groundwater, as regulated.  The RSC is filed in the Environmental Site Registry if the owner of the property wishes to obtain protection from potential future environmental orders.  In some cases, the filing of an RSC is mandatory if the land use is being changed, such as from industrial to residential.

The Environmental Protection Act (EPA) requires the qualified person to undertake certain activities that demonstrate that a property previously found to have contamination, or suspected of having contamination, now meets the applicable site condition standards, as specified in Records of Site Condition, O. Reg. 153/04.  To verify that the RSC has been filed, one can search the Environmental Site Registry by using the Registry website at www.ene.gov.on.ca.
